This application is to redesignate 22.93 hectares (56.67 acres) within Plan 202 0285; Block 1; Lot 4; Pt. NW-19-73-4-W6 from the Agricultural (AG) District to the Country Residential (CR-5) District to accommodate the subdivision of three (3) lots for country residential use.

 Background / Proposal

Current Zoning: Agricultural (AG) District

Farmland Assessment Rating:

25.00 acres at 18.3%

28.67 acres at 2.5%

 Overall Rating: 9.9%

Background and Analysis:

The applicant describes the topography as flat with existing pasture fields and an existing home site.

The Country Residential (CR-5) District’s purpose is to provide a residential district with opportunity for home occupation, majors, and agricultural pursuits.

The Municipal Development Plan (MDP) designates this area as Rural. Policies set forth in Section 6 and 7 of the MDP are most applicable. Policy 6.13 of the MDP states that in the Rural Area, land use bylaw amendments for the second residential parcel or greater must be clustered to prevent fragmentation of agricultural land and the land must be suitable for the intended use. Policy 7.3 of the MDP outlines criteria for considering land use bylaw amendments for country residential uses including suitability of site, water supply, sewage disposal, and access. The applicant has provided a model process report for proposed sewage disposal, and water supply and building area is deemed adequate for the proposed subdivisions. The application is consistent with the MDP.

Land uses in the area consist of the Agricultural (AG) and Country Residential (CR-5) Districts. Administration does not anticipate future land use conflicts to arise from this application.

Comments:

 

Transportation, Infrastructure, and Utilities Department: No concerns with the rezoning.

No concerns, subject to standard comments: County Safety Codes Department, Alberta Health Services, Alberta Energy Regulator, ATCO Electric, ATCO Gas, ATCO Transmission High Pressure Pipelines, and TELUS.

Motion 3: (requires unanimous consent)

That consideration be given to proceed to third reading of Bylaw 2680-23-036 to redesignate 22.93 hectares (56.67 acres) within Plan 202 0285; Block 1; Lot 4; Pt. NW-19-73-4-W6 from the Agricultural (AG) District to the Country Residential (CR-5) District at this meeting.

Motion 4:

That third and final reading be given to Bylaw 2680-23-036 to redesignate 22.93 hectares (56.67 acres) within Plan 202 0285; Block 1; Lot 4; Pt. NW-19-73-4-W6 from the Agricultural (AG) District to the Country Residential (CR-5) District.
